Judge Tosses iPad Overheating Lawsuit

The ruling says the allegations were "insufficient."

Computerworld: A class-action lawsuit that alleged false advertising about the iPad has been thrown out of court. A trio of plaintiffs said that Apple duped them into buying the device with claims that "reading on iPad is just like reading a book." However, unlike a book, the iPad shuts down when it overheats.

"The Court concludes that these allegations are insufficient," the judge in the case wrote. "At the least, Plaintiffs must identify the particular commercial or advertisement upon which they relied and must describe with the requisite specificity the content of that particular commercial or advertisement."

The plaintiffs have 30 days to file an amended lawsuit.
