Microsoft Appeals Over XML Spat, Again

Beginning today, Microsoft cannot sell versions of Word or Office with XML features enabled, but it's hoping to get that ruling reversed with yet another appeal.

TG Daily: Last August, a district court in Texas banned Microsoft from selling versions of their Word and Office software with XML features enhanced. According to the court, Microsoft was in violation of patents held by a Toronto-based technology company called i4i. Microsoft appealed. In December, that appeal was overruled, and the ban was set to begin today.

However, Microsoft has filed another appeal in the case. Spokesman Kevin Kutz says the appeal "details significant conflicts we believe the December 22 decision creates with established precedents governing trial procedure and the determination of damages, and we are concerned that the decision weakens judges' authority to apply appropriate safeguards in future patent trials."
